My Tennis Wall LLC Terms and Conditions
Using the Site
In order to access certain areas of the website, you must register an account with the My Tennis Wall LLC and submit your name, email address, preferred password, and other information requested on an account registration page. My Tennis Wall LLC shall have the right to approve or reject your account in My Tennis Wall LLC’s sole discretion.
By using this Site, you represent, acknowledge and agree that you are at least 18 years of age or the age of legal majority in your country of jurisdiction, or if you are under 18 years of age or the age of legal majority in your country but are at least 13 years old (a “Minor”), that you are using the Site with the consent of your parent or legal guardian who has agreed to the Terms. If you are a parent or legal guardian agreeing to the Terms for the benefit of a Minor, you are fully responsible for the Minor’s use of the Site, including all legal liability he or she may incur. If you are not at least 13 years old, you may not use the Site.
Purchases
To make purchases on My Tennis Wall LLC you acknowledge and agree that you must supply certain information relevant to your transaction to our third-party payment processor, Court Reserve, including, without limitation, your credit or debit card number, the expiration date of your credit or debit card, the name on your credit or debit card, and/or your billing address (the “Payment Information”). By providing the Payment Information, you expressly authorize us and/or our third party payment processor to charge the applicable fees to the payment method provided by you, as well as any applicable taxes and other charges incurred thereto. You agree that we (or our third-party payment processors) may charge any unpaid amounts to your provided payment method and/or send you a bill for such unpaid fees.
Intellectual Property
My Tennis Wall LLC retains all rights to the intellectual property used on our website, including but not limited to trademarks, logos, and copyrighted materials. You may not use any of our intellectual property without our prior written consent.
My Tennis Wall LLC Membership Terms and Conditions
1. Membership
Membership is subject to approval by My Tennis Wall LLC. Members must be at least 18 years old or supervised by an adult at all times with junior memberships. Membership fees, types, and benefits may vary and are subject to change. Membership benefits will vary based on membership type and is listed on our website at www.mytenniswall.com.
2. Rules and Regulations
Members must comply with all gym rules, policies, and guidelines, including safety instructions and proper equipment use. Simulators are used for the purposes of training and recreational use. There can be no more than 2 players at a time on a simulator unless under the instruction of a tennis coach. My Tennis Wall LLC reserves the right to refuse access or terminate memberships for any breach of these terms.
3. Guest Policies
Members are allowed 2 guests per month. Members must be present during simulator reservation. Guest allowance does not roll over to the next month. The same guest cannot attend more than once a month under the same membership, couples membership or family membership. Normal guest fees will incur a $15 charge. Any breach of guest policies will result in action against the member that brought the guest in. If a guest plays without the consent of My Tennis Wall LLC, the member will immediately incur a $35 charge for each offense. My Tennis Wall LLC reserves the right to terminate membership or charge penalties against the member account.
4. Liability Waiver
Members assume all risk of personal injury, death, or property loss resulting from any cause whatsoever, including negligence, breach of contract, or breach of any statutory or other duty of care.
5. Payment and Fees
Members agree to pay all applicable fees, charges, and taxes for their selected membership type. Members will be charged monthly for their selected membership level. Late or returned payments may be subject to additional fees.
6. Cancellation and Refund Policy
Members may cancel their membership by providing written notice according to the terms stated in the Notice for Cancellation Policy contract. Refunds, if applicable, will be processed according to the cancellation policy.
7. Personal Information and Privacy
Personal information collected will be managed according to the My Tennis Wall LLC Privacy Policy. My Tennis Wall LLC may use personal information for marketing purposes with the consent of the member, subject to applicable laws.
8. Changes to Terms and Conditions
My Tennis Wall LLC reserves the right to change these terms and conditions at any time. Members will be notified of significant changes.
9. Miscellaneous
These terms are governed by the laws of Texas. If any provision is found to be unenforceable, the remaining provisions will continue in effect.
By accessing or using our website, you agree to be bound by these Terms of Service. If you do not agree with these terms, please do not access or use our website.
